The Silent Struggle: Challenges Faced by Senior Citizens from Their Children and Legal Remedies in India
By Advocate Vivek Mohla
In the twilight years of life, senior citizens deserve peace, dignity, and care. Sadly, in many families across India, this vulnerable section of society is being neglected, abused, or exploited—often by their own children. Having worked closely with elderly clients and families in distress, I, Advocate Vivek Mohla, find it crucial to shed light on the often-overlooked struggles of senior citizens and the legal safeguards available to them under Indian law.
The Harsh Realities of Elder Abuse
The traditional Indian ethos of “Matru Devo Bhava, Pitru Devo Bhava” teaches us to revere our parents. However, modern-day cases reveal a disturbing trend of elder neglect and abuse, driven by property greed, family disputes, or sheer apathy.
Common Issues Faced by Senior Citizens:
-
Neglect of Basic Needs
Many elderly parents are left uncared for, denied food, medical attention, or even emotional connection, despite living in the same household as their children. -
Mental and Physical Abuse
Insults, threats, psychological manipulation, and even physical violence are inflicted upon the elderly by their own children or in-laws. -
Financial Exploitation
Forceful or deceptive transfer of property, misuse of pensions, and control over bank accounts have become increasingly common. -
Eviction from Own Homes
After transferring property to children out of love or trust, many parents find themselves thrown out of their own homes, left homeless and heartbroken. -
Legal Harassment and Isolation
In some cases, senior citizens—especially mothers—face false legal cases or domestic conflict leading to social and emotional isolation.
Legal Remedies Available for Senior Citizens in India
1. The Maintenance and Welfare of Parents and Senior Citizens Act, 2007
This landmark legislation provides a powerful mechanism for elderly parents to demand maintenance from their children or legal heirs.
-
Senior citizens (60+) can file an application before the Maintenance Tribunal for monthly maintenance.
-
Section 23 empowers them to cancel property transfers if the transferee fails to care for them.
-
The Tribunal is bound to dispose of the case within 90 days, ensuring timely relief.
2. Section 125 of CrPC (Code of Criminal Procedure)
Regardless of age, parents can approach a Magistrate under this provision to claim monthly maintenance if their children neglect or refuse to maintain them.
3. Protection under the Domestic Violence Act, 2005
While designed primarily for women, senior mothers facing abuse from sons or daughters-in-law can file complaints under this Act and seek protection orders, residence rights, and monetary relief.
4. Indian Penal Code (IPC) Provisions
Sections like:
-
Section 323 – causing hurt,
-
Section 506 – criminal intimidation,
-
Section 406 – criminal breach of trust,
can be used to register FIRs against abusive or exploitative children.
5. Revoking Gift Deeds and Property Transfers
If a senior citizen is deceived or coerced into transferring property, they can approach a civil court to declare such transfers as void, especially under Section 23 of the 2007 Act.
6. Senior Citizen Helplines and Police Support
Many states have established dedicated Senior Citizen Cells, such as:
-
Delhi Police Helpline: 1291 / 112
-
Regular visits by beat officers for elderly safety.
-
Quick redressal of complaints involving neglect or abuse.
7. Old Age Homes and Government Support
Under the 2007 Act, every state is mandated to create old age homes in each district. While not ideal, these homes offer shelter and support for those abandoned by family.
Words of Advice to Senior Citizens
-
Avoid gifting or transferring property without legally binding conditions for care.
-
Execute a Will instead of transferring ownership during your lifetime.
-
Keep documents safe and secure copies with a trusted lawyer or family member.
-
Seek help early. The law is on your side, and support is available.
Conclusion
The plight of senior citizens in today’s fast-changing society calls for collective sensitivity and legal awareness. No parent deserves to suffer indignity or neglect in their old age. If you or someone you know is facing such challenges, I urge you to take legal recourse without fear or delay. The Indian legal system offers ample protections—what’s needed is the courage to stand up and claim them.
